These Terms and Conditions ("Terms") govern your use of the instantSEE website and services operated by Instant SEE PTY LTD (ABN 54 697 701 652) ("instantSEE", "we", "us", "our"). By accessing or using our service, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Description

instantSEE provides an automated planning report generation tool that produces Statements of Environmental Effects (SEE) for residential Development Applications (DAs) in New South Wales, Australia. Reports are generated using data sourced from NSW Government planning services, including NSW Spatial Services, the NSW Planning Portal, ArcGIS MapServers, and the NSW Rural Fire Service.

2. Reports & Deliverables

Each purchase entitles you to one (1) report delivered in two formats: a council-ready PDF and an editable Microsoft Word document (.doc). Reports are professional drafts assembled from publicly available NSW government planning data. All reports remain available for download for 12 months from the date of generation.

Reports are provided as a professional planning tool only. While every effort is made to ensure accuracy and completeness, the applicant bears ultimate responsibility for reviewing all sections of the report before lodgement with the relevant consent authority.

3. No Guarantee of Approval

instantSEE does not warrant or guarantee that any Development Application will be approved by council. The SEE report addresses the matters for consideration prescribed under Section 4.15 of the Environmental Planning and Assessment Act 1979 (NSW). Council assessment involves additional discretionary considerations, site inspections, notification requirements, and policy factors beyond the scope of any written report. DA outcomes remain subject to the consent authority's independent determination.

The fee for a single report is $299 AUD (including GST). Payment is processed securely through Stripe, a PCI DSS Level 1 certified payment processor. All prices are in Australian dollars and include applicable GST. You will receive a tax invoice via email upon successful payment. Report credits have no expiry date.

6. Refund Policy

If a report fails to generate due to a technical error on our part, you are entitled to a full refund or a free regeneration of the report. If the SEE report is the reason your Development Application is formally rejected by council (i.e., council specifically identifies a deficiency in the SEE as grounds for refusal), we will either refund the $299 fee or rebuild the report to address the identified issues — at your election. Refund requests must be submitted within 90 days of the council determination. Refunds are not provided where the DA is refused for reasons unrelated to the SEE content (e.g., non-compliance with development standards, neighbour objections, or site constraints independent of the report).

To the fullest extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010):

8. Intellectual Property

The instantSEE name, logo, website design, and report generation methodology are the intellectual property of Instant SEE PTY LTD. The content of reports generated through the service — including the compiled planning data, compliance assessments, and formatted output — is licensed to you for the purpose of lodgement with the relevant consent authority. You may not resell, redistribute, or white-label reports generated by instantSEE without our prior written consent. You retain ownership of the factual information you input (property address, project specifications).

9. Third-Party Services & Data Sources

Our service depends on third-party data sources and services, including NSW Government spatial data services, Stripe (payment processing), and Resend (email delivery). We are not responsible for the availability, accuracy, or completeness of data provided by third parties. Government planning data may contain errors, omissions, or may be temporarily unavailable. We will use reasonable efforts to notify you of known service disruptions affecting report generation.

10. Privacy

We collect, use, and store your personal information in accordance with our Privacy Policy, which forms part of these Terms. By using the service, you consent to the collection and use of your information as described in the Privacy Policy.

11. Prohibited Use

You agree not to: misuse the service for any unlawful purpose; attempt to circumvent payment or credit systems; use automated means to generate reports at volumes that degrade service for other users; resell or redistribute reports without authorisation; or upload malicious code or interfere with the security of the service.

12. Termination

We reserve the right to suspend or terminate your access to the service at our sole discretion if you breach these Terms. Upon termination, you will retain access to any previously purchased reports for the remainder of the 12-month retention period.

13. Dispute Resolution

In the event of a dispute arising from these Terms, both parties agree to first seek resolution through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue their rights through the courts of New South Wales.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of the service after changes constitutes acceptance of the updated Terms.
